HostExpress.com LLC provides hosting and related services. These Policies, Guidelines, and Disclaimer apply to all clients and domains as well as resellers clients and domains residing on HostExpress.com LLC's servers.  HostExpress.com LLC requires customers to maintain valid contact information as well as valid end user contact information for any services that are being resold.

Age:
Must be 18 or older to use service.

Content:
All services provided by HostExpress.com LLC may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of United States Federal, State or Local law and regulated private/sensitive information is prohibited.  This includes, but is not limited to: unauthorized use of copyrighted material, material we judge to be threatening or obscene, unauthorized use of material protected by trade secret and other statute, credit card, financial and medical information. The subscriber agrees to indemnify and hold harmless HostExpress.com LLC from any claims resulting from the use of the service which damages the subscriber or any other party.  Pornography and sex-related merchandising is prohibited on all HostExpress.com LLC's servers. This includes sites that may infer sexual content, or links to adult content elsewhere.   Web sites, account usage and links that promote any illegal activity or present content that may be damaging to HostExpress.com LLC, other providers, individuals, servers and or devices connected to the internet are prohibited.   Other examples of unacceptable use are, pirated software, hacker programs or archives, sites that promote the use of unsolicited email (Spam), warez sites, sites that promote hate, or are prodigious to others, sites offering prescription drugs and gambling. 

The following is a list of sites that will often require additional systems resources:  Sites being targeted by automated bots, IRC, forums, banner member scripts, archives or galleries, (i.e. .gif, .jpg, .exe, .zip, .tar, etc.), and domain accounts offering download files.  We are not saying that your web site can not contain such activities/content, however if they consume too many systems resources they may be limited and or you may be contacted to resolve the problem.  HostExpress.com LLC will be the sole arbiter as to what constitutes a violation of this provision.

Traffic, Disk Usage, Statistics and Email
Hosting services come with a predetermined amount of resources.  HostExpress LLC provides tools to view web site resource usage and will invoice and charge additional fees for storage and bandwidth overuse. 

HostExpress LLC makes every effort possible to provide all the resources your web site requires however these plans are intended for the average small businesses web site and not large scale commercial sites. HostExpress LLC has set limits for CPU and memory usage as well as other resources such as disk I/O.  Limits and usage can be viewed in our hosting control panel.  In the event a site and or client uses too many resources, such usage will be limited to maintain system stability.

Log files are rotated daily and archived for the 2 days.  Web Site statistics are offered "as is" and if activated by the customer should be automatically generated.  If statistics are not generated before log files are rotated the statistics will not be available for that time period. 

All items listed as "Unlimited" including but not limited to  domains, email, databases are not restricted by a physical number but will require the purchase of additional system resources when these system resource limits are reached. 

Email will be kept on the server for a period of 90 days or longer depending on the hosting plan you choose.  Users should download their email and keep an off site back up of all messages.  To increase the performance of the servers and reduce download issues we encourage users to delete messages from the server once they are read.

Due to the large volume of spam our servers receive we implemented RBL services from Spamcop.net and Barracuda on all email accounts.  Furthermore HostExpress LLC reserves the right to block, bounce, discard or filter any email sent to or from our servers or network.  Email forwards to providers that blacklist email sent from our service will be removed.  Please keep in mind these forwarded emails can would never reach their destination address if they are being blocked.

Commercial Advertising - Email:
Spamming, or the sending of unsolicited email, from an HostExpress.com LLC's server or using an email address or domain that is maintained on an HostExpress.com LLC machine as reference is STRICTLY prohibited. This includes sending mass mailings to email addresses that did not "Opt In*" from a domain that is maintained on an HostExpress.com LLC machine.  HostExpress.com LLC will be the sole arbiter as to what constitutes a violation of this provision. 

* Any user that joins a list must be sent an email to the address they signed up asking for them to verify they joined the list.  That user will not be added to the list until they perform some sort of authentication such as replying to the message or clicking on a link.  (double opt-in)  Logs or double opt-in info. should be saved for users that join such mailing lists and HostExpress.com LLC reserves the right to request this information for any mailings being conducted from our servers.  Failure to provide such information may result in mailing privileges being revoked or the web site and or user removed from our service.

Offering Free Services
HostExpress.com LLC will not allow clients to run free services.  This includes but is not limited to free email, free home pages and free hosting.  These "free" services can be hosted on our dedicated servers.

Offering Automated Account Creation
HostExpress.com LLC will not allow automated hosting or email account creation scripts.

Server Abuse:
Any attempt to undermine or cause harm to a server, or customer, of HostExpress.com LLC is strictly prohibited.

Refusal of Service:
HostExpress.com LLC reserves the right to refuse, cancel, or suspend service at our sole discretion.

All Sub-Networks, distributive hosting sites and dedicated servers of HostExpress.com LLC must adhere to the above policies.

BILLING:

All credit cards are billed automatically for hosting and hosting overage fees.  The first months fees are pro-rated based on a 30 day month for the number of remaining days in the month the account was ordered. Fees for new sites are invoiced on or about the first of the proceeding month for the term that plan is billed and include any applicable setup fees and the pro-rated amount for the month the site was ordered.  It is the clients responsibility to ensure that they have sufficient credit to cover this transaction. In the event that there is insufficient credit, as a courtesy we will send an email notification at which point we will need to be provided with another credit card within 15 days. If we do not receive a response within 15 days the account will deactivated and data loss will occur upon account deletion.

Account Deactivation:
Any account deactivated due to non-payment will be deactivated and we require a reactivation fee of $50.00 to be paid prior to reactivating the account.

30 Day Money Back Guarantee/Refunds:
Regular none-dedicated Hosting Clients - Should you become unsatisfied with our services within the first 30 days of your account activation, HostExpress.com LLC will refund your hosting fee.

Cancellations:
HostExpress.com LLC's DOES NOT refund fees for accounts canceled after 30 days from the initial account activation.  All cancellation requests must be received at least 15 days prior to the billing due date.   Cancellations may not be complete until you receive confirmation by email from HostExpress.com LLC.

REFUSAL OF SERVICE:
HostExpress.com LLC reserves the right to refuse, cancel, or suspend service at our sole discretion.

LIMITATION OF LIABILITY:
HostExpress.com LLC shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from HostExpress.com LLC's servers going off-line or being unavailable for any reason whatsoever. Furthermore, HostExpress.com LLC shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption, deletion or hacking of any web site from one of HostExpress.com LLC's servers.  Violations of these Acceptable Uses Policies should be referred to: cs@hostexpress.com

All received complaints will be investigated.  Failure to follow any term or condition will be grounds for immediate account deactivation.

DISCLAIMER:
HostExpress.com LLC's cannot be held liable for system downtime, server hacking, crashes, data loss and or any predicted estimate of profits in which a client would have gained if their site was functioning.  HostExpress.com LLC does not maintain content or software installed by customers and is not liable for software hacking or copyright infringements as a result of installed software or uploaded content.  Customers are responsible for and must keep all content up-to-date and apply all available software updates.  HostExpress.com LLC does regular backups and or includes backup utilities for many of our services but in no way guarantees these backups.  It is the clients / account holders responsibility to keep a backup copy of their data stored outside our Network and or servers.  Certain services provided by HostExpress.com LLC are resold. Thus, certain equipment, routing, software, and programming used by HostExpress.com LLC are not directly owned, operated or maintained by HostExpress.com LLC. Moreover, HostExpress.com LLC holds no responsibility for the use of our clients accounts. If any terms or conditions are failed to be followed, the account in question may be deactivated. We reserve the right to remove any account or files without advanced notice for any reason without restitution as HostExpress.com LLC sees fit. 

ACCOUNT ACTIVATION:
By activating your account with HostExpress.com LLC, you agree to the above policies and disclaimer. Upon requesting an account activation, you are required to accept these policies, guidelines, and disclaimer and a copy of your acceptance is forwarded along with your activation request to be maintained within your account information.

NOTICE:
If you sign up for an account and do not follow our terms No refunds will be given.  FURTHERMORE, HostExpress.com LLC Network retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification. We also retain the right to increase any pricing, and make changes to our account plans without notification.

**If your account is found to contain illegal activity, Illegal MP3 Files, Pirated software, hacker programs, Warez programs, or any other illegal files, your account will be terminated immediately without notice and a $50.00 Cancellation fee will apply. ** Also the proper (and your local) authorities will be notified of your actions.

HostExpress.com LLC will be the sole arbiter in determining violations of these terms and conditions.

Domain Registration Terms

Privacy Notice

Hostexpress.com, LLC (herein referred to as "Hostexpress.com") collects personal information, including the full name, company name (if provided), address, credit card number and expiration date, email address, and source IP address for all customers for the purpose of providing web hosting and related services.

Security
Although 100% security is impossible, Hostexpress.com takes personal information security very seriously.  Credit card information is stored with a third party payment processor and Hostexpress.com employs industry-standard safeguards, including but not limited to access control, encryption of credit card information, password and/or key-based authentication controls on servers which house personal information and browser-based encryption.

Access
Customers have access to account-specific personal information stored about them via Hostexpress.com's web-based portal and may update their information at any time.  Please contact privacy@Hostexpress.com if you need to change the name on your account.   Customers who cancel their account may request that their personal information be deleted from Hostexpress.com's databases except in cases where data is needed for complying with our legal obligations, resolving disputes, and enforcing our policies.

Third Party Disclosure

Hostexpress.com transfers personal data to third parties for merchant and backup services.
Hostexpress.com discloses the full name, billing address, and credit card account information of its customers to a third party merchant processing provider for billing and fraud detection purposes. Hostexpress.com will disclose customer information to other third parties where required under applicable local, state and federal laws for purposes of investigation of criminal complaints, or where required by court order.

Cookies
We collect anonymous usage information on visitors to our site through use of Google Analytics. This service may employ third party tracking cookies to gather anonymous browser, operating system, geographic, and web site navigation information. Use of our Hostexpress.com Portal interface requires the acceptance of cookies for login session management purposes.

Hosting Service
Customers bear sole responsibility for maintaining the security of their hosting account(s), files and applications. Customers are solely responsible for ensuring compliance with any and all applicable privacy guidelines and regulations for all jurisdictions in which they may operate with respect to appropriate practices for the collection, storage, and dissemination of personal information using their Hostexpress.com account. In no event shall Hostexpress.com be held liable for a customer's failure to adopt and/or practice appropriate measures for safeguarding personal information stored within or transmitted through their Hostexpress.com account.

Changes
Amendments to this privacy policy may be made at any time and you should check back frequently for changes.
